Woman Charged with Forcing Man to Have Sex… But not for Rape
Samantha Ray Mears, a 19-year-old American girl, broke into her ex-boyfriend’s home holding a machete, entered his room, and instructed him to take after his pants. After doing so she proceeded to have sex with him with the machete in her hand. After the sex had ended, the un-identified man excused himself to supposedly call a friend but called the police instead.
Samantha fled the scene of the crime but was arrested soon after. She now faces six criminal charges. The charges announced against Samantha Ray are as follows: aggravated battery, assault with a weapon, unlawful restraint, partner family member assault and two counts of criminal mischief. Certainly, her heinous crimes include these charges, but there is one big charge missing.
Why is it that this girl who ordered a man to have sex with her under threat of violence with a deadly weapon is not being charged with rape? Clearly, rape is the unlawful act of sex with a person who has not consented. Certainly, intimidating a person with a weapon to order them to copulate with you falls squarely under that definition.
